Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the job portal and employer/candidate portal provided by Di Spane (Pty) Ltd (“Company”), located in Botswana. By accessing or using the portals, you agree to comply with these Terms. If you do not agree with any provision of these Terms, you may not access or use the portals.

  1. Definitions

    a. “Job Portal” refers to the online platform provided by the Company, allowing employers to post job vacancies and candidates to search and apply for jobs.

    b. “Employer/Candidate Portal” refers to the online platform provided by the Company, enabling employers to manage job postings and candidates to manage their profiles and job applications.

    c. “Company” refers to Di Spane (Pty) Ltd, a company incorporated under the laws of Botswana.

    d. “User” refers to any individual or entity accessing or using the job portal or employer/candidate portal.

    e. “Content” refers to any information, data, text, images, or other materials posted or transmitted by users on the portals.

  2. Use of the Portals

    a. Eligibility: Users must be at least 18 years old to access and use the portals. By accessing the portals, you represent that you are of legal age.

    b. Account Registration: In order to use the employer/candidate portal, users are required to create an account by providing accurate and complete information. Users are responsible for maintaining the confidentiality of their account credentials and are solely responsible for all activities that occur under their account.

    c. User Obligations: Users agree to use the portals for lawful purposes and in compliance with these Terms. Users will not engage in any activity that may harm, interfere with, or disrupt the portals or the Company’s services. Users will not post any false, misleading, or offensive content, and will not infringe upon any third-party rights.

    d. Modifications: The Company reserves the right to modify, suspend, or discontinue the portals or any part thereof, at any time and without notice. The Company shall not be liable for any damages arising from such modifications, suspensions, or discontinuations.

    e. Termination: The Company may terminate or suspend a user’s access to the portals, without prior notice or liability, for any reason, including a breach of these Terms. Upon termination, users must cease all use of the portals and any associated content.

  3. Job Postings and Applications

    a. Job Postings: Employers are solely responsible for the accuracy, completeness, and legality of their job postings. The Company does not guarantee the availability or suitability of any job posting or position.

    b. Application Process: Candidates may apply for job vacancies through the job portal. Candidates are responsible for the accuracy and completeness of their application materials. The Company does not guarantee that any application will result in an interview, job offer, or employment.

    c. Candidate Profiles: Candidates may create and manage their profiles on the employer/candidate portal. Candidates are responsible for ensuring that their profile information is accurate and up to date. Candidates may choose to make their profiles visible to employers or restrict access as desired.

    d. Employer Screening: Employers may screen candidate applications and profiles. The Company does not guarantee the accuracy, completeness, or legitimacy of any employer screening process, and candidates are solely responsible for assessing and verifying employers and job opportunities.

    e. Communication: The portals may provide communication features for employers and candidates to interact. Users agree to use such features responsibly and in compliance with applicable laws. The Company is not responsible for any communications or transactions between employers and candidates.

  4. Intellectual Property

    a. Ownership: The portals and all intellectual property rights associated with the portals are owned by the Company. Users do not acquire any ownership rights by accessing or using the portals.

    b. License: By posting or transmitting content on the portals, users grant the Company a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of providing the portals’ services.

    c. Restrictions: Users shall not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the portals, except as expressly permitted by these Terms.

  5. Disclaimer of Warranty and Limitation of Liability

    a. No Warranty: The portals are provided on an “as is” and “as available” basis without any warranty or condition, express, implied, or statutory. The Company does not warrant that the portals will be uninterrupted, error-free, or secure, nor does it make any representations regarding the accuracy or reliability of any content or information obtained through the portals.

    b. Limitation of Liability: To the extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the portals or these Terms, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.

  6. Governing Law and Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of the Republic of Botswana. Any disputes arising out of or relating to these Terms or the portals shall be subject to the exclusive jurisdiction of the courts located in Botswana.

  7. Severability

    If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

By accessing or using the portals, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
